Las Vegas DUI Criminal Penalties

If you are convicted of a 1st time DUI—driving under the influence of drugs or alcohol, or driving with +.08% blood alcohol content—Nevada law dictates the following penalties*:
1. Between 2 days and six months in jail (or, in some cases, with court approval, a minimum of 96 hours of community service)
2. A base fine of anywhere from $340 – $2,000 plus additional fees
3. Suspension of your driver’s license for 90 days (in order to have it reinstated, you must pay varies fees, pass additional tests, and submit an SR-22 proof of insurance form)
4. Completion of a court-approved 8 hour DUI School and/or substance abuse program
5. Attendance at a Victim’s Panel
6. Possible mandatory installation of an Ignition Interlock Device for 3 to 6 months
7. If blood-alcohol level is .18% or higher: you must submit to an alcohol abuse assessment

If you are arrested within seven years of a previous DUI (i.e. this is your 2nd DUI in seven years), the following penalties are increased*:

1. Minimum jail term is 10 days instead of 2 (the maximum remains at 6 months)
2. The base fine is anywhere from $675 to $2,000, plus additional fees
3. Drivers’ license suspension is increased to 1 year instead of 90 days

A third DUI conviction within 7 years is a felony and triggers the following provisions*:
1. Incarceration in state prison for minimum 1 year, up to 6 years
2. Fines of anywhere from $2,000 – $5,000+
3. Driver’s license revoked for 3 years

*note: all of these penalties assume no one was drastically injured in the accident. If you are convicted of a DUI and you have also caused bodily harm to other parties involved, the charges may be severely higher/worse for you. A DUI/DWI which involved an accident causing death or substantial bodily injury to another individual(s) is also a felony, punishable by anywhere from 2-20 years in state prison.
